Title VI/Non-Discrimination Program Complaint Form

NYMTC’s Title VI/Non-Discrimination Complaint Procedure is the process by which NYMTC receives and investigates complaints of discrimination while ensuring due process for complainants and respondents. The procedure does not preclude NYMTC from attempting to informally resolve complaints where possible. All complaints are routed to the Federal Highway Administration’s (FHWA) Regional Office as FHWA is responsible for all decisions regarding whether a complaint should be accepted, dismissed, or referred to another agency. The Title VI/Non-Discrimination Complaint Procedure applies to all external complaints of discrimination relating to NYMTC’s metropolitan transportation planning process, filed under Title VI of the Civil Rights Act of 1964 (including related Disadvantaged Business Enterprise (DBE) and Equal Employment Opportunity (EEO) provisions), as well as other related laws, regulations, executive orders and directives as specified in NYMTC’s Title VI/Non-Discrimination Program which prohibit discrimination on the basis of race, creed, color, national origin, sex, marital status, disability, age, sexual orientation or income level.

The Complaint Procedure is an administrative process that does not provide for remedies that include punitive damages or compensatory remuneration for the complainant. Intimidation or retaliation of any kind is prohibited by 49 CFR Part 21.11(e). Under this procedure, any individual (or their representative) who believes they have been subject to discrimination in NYMTC’s metropolitan transportation planning process that is prohibited by Title VI and other nondiscrimination provisions, has a right to file a complaint within 180 calendar days of the alleged occurrence. The complainant also has a right to forward the complaint to any of the below ensuring that the required information is included. Complaints must be in writing and transmitted by hard copy, fax or by email.
