These federal requirements include transportation authorizing legislation Moving Ahead to Progress in the 21st Century, or MAP-21, that details specific actions the MPO must take in the regional transportation planning process, and varying statutes and regulations to which it must adhere.


Operating Procedures

NYMTC develops its own Operating Procedures to establish specific goals, methods and outcomes for ensuring it meets the federal requirements.

Infrastructure Investment and Jobs Act

On November 15, 2021, President Biden signed the Infrastructure Investment and Jobs Act (IIJA) (Public Law 117-58, also known as the “Bipartisan Infrastructure Law”) into law. The IIJA is the largest long-term investment in the Nation’s infrastructure and economy in history.

Accessibility and Americans with Disabilities Act (ADA) 

The Americans with Disabilities Act (ADA) was passed in 1990 to ensure that people with disabilities are treated fairly. The law prohibits discrimination against individuals with disabilities in employment, transportation, public accommodations, and communications.

Self Certification

Self-certification is a required element of New York’s  State Transportation Improvement Program (STIP).  All MPOs, concurrent with the submittal of the entire proposed TIP to FHWA and FTA  as part of STIP approval, certify at least every four years that the metropolitan transportation planning process is being carried out in accordance with all applicable federal planning requirements (23 CFR 450.334). MPOs’ signed self-certification resolutions become part of the Appendices to the STIP.  The narrative written in support of the resolution (responding to NYSDOT checklist questions) is not a federal requirement but is requested by NYSDOT as background documentation for MPO action on self-certification.  TMA MPOs do not have to self-certify if they are undergoing the federal certification process at the time new TIPs and the STIP are being developed.  NYSDOT guidance on self-certification can be found here
